Intentional tort
There are five categories of tort
Intentional tort – Under this the intention of the person is questioned
property tort – It is related to the rights invaded related to the property (infringement of property rights)
dignitary tort – It means a tort that causes injury to a person’s name , fame , honour ,reputation , goodwill
economic tort – also known as business tort , an act that causes havoc business transaction such as interference with business economic relations
and other tort.
Intentional tort includes assault, battery, false imprisonment.
Property tort includes trespass to land, wrongful conversion, trespass to goods.
Dignitary tort includes defamation, invasion of privacy, breach of confidence, malicious prosecution.
Economic tort includes tortious interference, tortious conspiracy, fraud, restraint to trade.
Intentional tort is basically an act done by a person with an objective ,a purpose with a clear mindset to cause wrongful damage. An act which is intentional in nature and is done for a wrong purpose.
The intention of the person is questioned and assumed when a person has committed a crime .
The intention matters a lot when it comes to coming to a verdict. If a person with wrongful intention , in order to just scare or frighten the person , runs behind the person with a stick , would amount to intentional tort . While , If a person while playing cricket by mistake hits the ball in such a way that it hits the head of a person , would not amount to an act of tort as there was no intention here to harm the person in any way.
Assault- assault is an act that frames or constructs other person‘s mind in fear of physical damage.
Example a person is running behind another person with a stick in his hand is an example of assault as there is no physical contact but the person running has a fear of getting hit which can cause physical damage.
Battery is unlike assault, it is an actual contact with the other person.In this case , the intention of the person is to cause wrongful damage and has a clear mindset and objective towards a person and is well aware what would be the after effects of his/her particular actions.
For example – A person pissed on his neighbour due to some reason , takes his gun and run towards the his neighbour and hits the person from the bullet . Under this illustration we can clearly understand that , the person knew that firing a gun would cause physical damage to the person , it decided to proceed , plus there was physical contact .
False Imprisonment is confining a person within a specific area and restricting the movement of the person or individual without its consent or justification.
Example a bus when hijacked by terrorist a restricted the passenger travelling tin the bus to move .
It restricts the free movement of the public or person travelling .
, This could be situation of false imprisonment
